Terms and Conditions

Please read these Terms of Service carefully, as they contain important information regarding your rights and obligations.

By booking accommodation on our website, through our customer service and/or by using the facilities of the Ewokk, you agree to be bound by these Conditions and to comply with them. These Terms constitute a legally binding agreement between you and Ewokk (as defined below) that governs your access to and use of Ewokk Accommodations and all related services. A reminder of these Conditions will be sent by email within 24 hours of booking.

We offer a Bed and Breakfast type rental service located at 27-A rue Pleasant, Sutton, Quebec, Canada, J0E2K0. It is possible to book Accommodation in several ways: through the Ewokk website or by telephone with Ewokk customer service.

The terms “Ewokk” “Accommodation” “Bed and Breakfast”, “we”, “us” or “our” used in these Terms refer to Ewokk.ca Inc. having its head office located at 2716 Lapierre, Montreal, Quebec , H8N 2W9, CANADA.

Glossary

Terms: These Terms of Service. Anyone using the website or rental service must comply with these Terms.

Agreement: Acceptance of these terms of service constitutes the Agreement that binds the User of the Service to Ewokk.

Service: We offer a room rental service through our website.

Stay: The period during which the Accommodation is rented by the Tenant.

Accommodation: The rooms offered by Ewokk are collectively referred to as “Accommodation”.

Site: The Ewokk website.

Renter: The person with whom a Rental Agreement has been entered into. It is responsible for ensuring compliance with these Conditions and will be held liable for any breach of these conditions by any person present within the Rented Accommodation.

Guests: Person present in the enclosure of the Ewokk, but not registered on the rental contract. These Conditions apply in full and throughout the duration of the contract for Guests, in the same way as for Tenants.

Users: Renters and Guests together are “Users”.

Pre-Authorization: Amount charged to Renter’s credit card as a security deposit to cover charges and damages incurred during room rental.

Dispute: Action by a User that does not comply with our Terms of Use and may result in a charge on the Pre-authorization.

  1. Scope of Ewokk Services
    • 1.1 Ewokk is an Accommodation rental service for holidays, events or any other use approved by Customer Service and which complies with these Terms and Conditions.
    • 1.2 The reservation of Ewokk Accommodation can be made at any time by means of the reservation tool of the Site or with Customer Service by telephone during the opening hours which can be viewed on our Site.
    • 1.3 The Ewokk Site may contain links to third-party websites or resources (the “Third-Party Services”). These Third-Party Services may be subject to different Terms of Service and privacy practices. The Ewokk is not responsible for the availability or accuracy of such Third Party Services, or the content, products or services available from such Third Party Services. Links to such Third Party Services shall not be construed as an endorsement by Ewokk of such Third Party Services.
    • 1.4 Parking for one vehicle is included free of charge in the rental of Accommodation. The Tenant is required to use exclusively the parking space reserved for him and whose number will be provided in the reservation confirmation email. Any additional vehicle must park in the public parking lot of the Town of Sutton.
    • 1.5 Arrival at the Accommodation is done independently. Once his reservation has been confirmed by the reservation confirmation email, the Tenant does not need to register once he arrives at the Ewokk. The unlocking of the house and the rooms is done using a digital code lock. The code is sent to the Tenant by email on the day of his reservation.
    • 1.6 Under no circumstances shall Ewokk be held liable for damages of any nature whatsoever, including actual or consequential damages, loss and/or breakage of personal property, injury and/or death resulting from the use of the Service, associated activities and services or personal equipment during the rental of our Accommodation.
    • 1.7 Ewokk declines all responsibility in the event of theft or damage to personal effects both in the Accommodation and in the common premises. Ewokk cannot be held responsible in the event of theft or damage to personal items. It is recalled that the parking lots are not supervised and therefore that Ewokk declines all responsibility in the event of an incident on customer vehicles. Eau Villa also declines any liability relating to the civil liability of Users.
  2. Eligibility, Use of Service
    • 2.1 To book Accommodation in Ewokk and be able to stay there, you must be a natural person at least 18 years old or a business, organization or other legal person duly incorporated, recognized and in good standing under the laws of the country. in which you are established, and have the capacity to contract.
    • 2.2 We reserve the right to deny access to the Services to any person at any time for any reason.
    • 2.3 The period during which the Accommodation is rented by the Renter (the “Stay”) begins when the Renter takes possession of the premises and runs until the moment the Rental Agreement ends. It is the Renter’s responsibility to notify Ewokk Customer Service of an early departure.
    • 2.4 Users are responsible for identifying, understanding and complying with all laws, rules and regulations applicable to the use of the Service. Use of our Service for any illegal or unauthorized purpose is prohibited.
  3. Modification of the Service, prices and Conditions
    • 3.1 Ewokk reserves the right to modify these Conditions at any time in accordance with this article. If we modify these Terms, we will post the modified Terms on the Ewokk Site by changing the “Last Updated” date at the top of the Terms. If you do not terminate your Agreement before the effective date of the amended Terms and you continue to access the Site or use our Accommodations, you will be deemed to have accepted the amended Terms.
    • 3.2 All our prices are subject to change without notice.
    • 3.3 We reserve the right to modify or discontinue the Service (and any part or content of the Service) without notice at any time.
    • 3.4 We are not liable to you or any third party for any price change, suspension or discontinuance of the Service.
  4. Use of the Website
    • 4.1 The design of the Website and all text, graphics, information, content and other materials displayed on this Site or available for download, including but not limited to text, data, backgrounds screen, icons, illustrations, images, photographs, music, sound, messages, text and HTML code used to generate the pages are the exclusive property of Ewokk. You may not in any way use or modify the information, content or materials on this website, or reproduce or display, perform, distribute or use any such materials for any public or commercial purpose. Any unauthorized use of this information or materials may violate copyright laws, trademark laws, privacy and publicity laws, and other laws and regulations.
  5. Payment, Transaction, Currencies and Exchange Rates
    • 5.1 All prices are quoted in Canadian dollars. Taxes (QST and GST) are in addition to the advertised amounts. All payments are made in Canadian dollars. Due to fluctuations in the exchange rate, it is possible to observe slight variations between the amounts initially invoiced and the amounts reimbursed. Ewokk cannot be held responsible for variations in the exchange rate.
    • 5.2 When booking, payment for the entire stay is made by credit card (cards accepted are Visa, Mastercard). The transaction is immediately debited from the customer’s bank card after verification of the latter’s data. By communicating the information relating to his credit card, the customer authorizes Ewokk to debit his credit card for the amount of the entire stay. To this end, the customer confirms that he is the holder of the bank card to be debited and that the name appearing on his bank card is indeed his. Checks are not accepted by Ewokk.
    • 5.3 Credit card refunds may take up to 15 working days depending on your financial institution.
    • 5.4 Promotional offers must be redeemed at the time of booking. It is no longer possible to use them once the transaction has been made.
  6. Pre-authorization
    • 6.1 A pre-authorisation) will be retained on the Renter’s credit card 48 hours before the start date of the Stay and will be returned 72 working hours after the end of the Stay subject to compliance with these Conditions. We do not accept prepaid credit cards or debit credit cards.
    • 6.2 The Pre-authorization is necessary to cover the costs incurred by the Tenant and/or one of his Guests in the event of an incident, breakage, negligence as well as for any behavior deemed not to comply with our Conditions (the ” Disputes”).
    • 6.3 The Pre-authorization of any Tenant involved in a Dispute may be withheld for up to 30 days in order to allow us to determine the actual amount of the costs incurred by said dispute.
  7. Damage to Accommodations
    • 7.1 As a User, you are required to return the Accommodation (including all property in the Accommodation) in the condition in which you found it on arrival. You are responsible for your own actions and omissions and those of anyone you invite into the Accommodation, or to whom you give access to the Accommodation.
    • 7.2 If Ewokk finds that you, as a User, have caused damage to an Accommodation or to property in an Accommodation, Ewokk, after the end of your stay, will recover from you and/or collect on the Pre-Authorization the amount necessary to resolve and remedy the Dispute. In addition, Ewokk reserves the right to recover any amount from you and to exercise all remedies available to it in the event that your liability in the context of a dispute is established. You may appeal a decision made by Ewokk based on this Section 7.2 by contacting Customer Service. Decisions made by Ewokk in connection with a Dispute do not affect your contractual or legal rights. This clause does not affect your right to sue in court.
  8. Booking Changes, Cancellations, Refunds, and Reviews
    • 8.1 In the event of modification or cancellation of a Stay, the following policy applies:
    • 30 days before arrival: stays can be canceled or modified. A cancellation will result in the full refund of the amount of the reservation less the service charge. In case of modification, if the rate of the new reservation is higher than that of the initial reservation, the payment of the remaining balance will be required. Changes are subject to booking calendar availability and cannot be guaranteed.
    • Between 29 and 15 days before arrival: Stays cannot be canceled, only modifications are authorized. Cancellation results in the loss of 100% of the reservation amount, plus applicable taxes. Any modification of a reservation will result in a fee of $75, plus applicable taxes. If the rate of the new reservation is higher than that of the initial reservation, payment of the remaining balance will be required. (However, no refund will be made if the rate of the new reservation is lower than that of the initial reservation). Changes are subject to booking calendar availability and cannot be guaranteed.
    • 14 days and less before arrival: Stays cannot be canceled or modified. Cancellations result in the loss of 100% of the reservation, plus applicable taxes.
    • 8.2 The Ewokk Customer Service is the only one authorized to make a decision concerning any request for modification, cancellation and refund of reservation. All rental cancellation or modification requests must be made in writing to info@ewokk.ca.
    • 8.3 The fact of not having used the services provided for during the Stay cannot give rise to a refund.
    • 8.4 Any request to modify or cancel a stay in connection with COVID-19 will be examined on a case-by-case basis.
    • 8.5 Ewokk reserves the right to refuse any request for modification of stay or special request. Fees may apply for certain requests. In the event that Ewokk is unable to honor your reservation, we will not be held responsible for any costs incurred.
    • 8.6 If you are unable to show up or make it to one of our accommodations for the first night of your booking, but wish to use the remainder of your stay, you must notify Customer Services at the latest on the rental date initially scheduled to avoid the cancellation of your reservation. If you do not confirm the reservation change with Customer Service, the entire reservation is subject to cancellation and no refund will be issued.
  9. Responsibilities and obligations of Tenant
    • 9.1 The cut-off time for vacating the Accommodation is set at Noon (check-out). You agree to leave the Accommodation no later than the occupancy deadline specified in this article. If you stay beyond the occupancy deadline without the agreement of Customer Services, you are no longer authorized to occupy the Accommodation, we are entitled to remove you from the Accommodation by means in accordance with applicable law. If you occupy the accommodation longer than expected, you authorize Ewokk to charge you for the collection of unduly extended stay fees on your pre-authorization.
    • 9.2 The time of arrival (check-in) is from 4 p.m. on the day of the start of the rental. It is not possible to access the Accommodations or use the parking space included with the booking before this time.
    • 9.3 All Ewokk Users must comply with local regulations, including those of the town of Sutton.
    • 9.4 You are required to report any incident or accident occurring on the premises of the Ewokk to Customer Service within 48 hours of the event.
    • 9.5 It is strictly forbidden to smoke in our Accommodation, this excludes the outdoor terrace, you must however be at least 9 meters from the building. An amount of $250 will be deducted from the pre-authorization if we consider that you have not complied with this instruction.
    • 9.6 It is forbidden at all times to make noise that disturbs the peace or tranquility of people present in the Accommodation areas. A fee of $350 will be deducted from the pre-authorization if noise pollution is observed.
    • 9.7 It is your responsibility to adapt safe behavior taking into account the risks you take by swimming without protection or supervision.
    • 9.8 Ewokk offers aquatic facilities (swimming pool and spa) and this entails certain risks. We want to make Users aware of the dangers of drowning. We recommend being vigilant at all times. Children must be supervised at all times when in outdoor areas. Children under the age of 8 must wear a vest. personal flotation device (PFD) at all times when they are in the pool enclosure. Children 8 and under are not allowed in the spa.
  10. Associated activities and services
    • 10.1 Any free or paid activity offered with the rental of our Accommodation may, under certain circumstances, be modified or canceled upon your arrival, without notice.
    • 10.2 You are responsible for any damage to or loss of equipment associated with your accommodation during the rental period. We reserve the right to deduct the amount of replacement or repair of the latter from the pre-authorization.
  11. Pet Policy
    • 11.1 Pets are strictly prohibited.
    • 11.2 In the event of damage caused by a pet, the cost of repair will be deducted from the Pre-authorization.
  12. General provisions
    • 12.1 These Terms, together with any additional terms, policies, rules or standards that supplement them, constitute the entire agreement between Ewokk and you relating to the subject matter hereof, and supersede all agreements and understandings prior, verbal or written, between Ewokk and you regarding access to the site, accommodations and their uses.
    • 12.2 These Terms of Service do not and are not intended to confer any rights or remedies upon any person other than the parties.
    • 12.3 If any of the clauses of these Conditions are declared invalid, void or unenforceable, said clause will be canceled without its cancellation affecting the validity and applicability of the remaining clauses.
    • 12.4 You are prohibited from assigning, transferring or delegating this Agreement and your rights and obligations hereunder without the prior written consent of Ewokk. Ewokk may, without restriction and in its sole discretion, assign, transfer or delegate this Agreement and any rights and obligations hereunder upon 30 days notice.
